2. Scope of this document
These Terms of use (the "Terms") govern access to and use of:
- the cardlink.bg website and all its subdomains (the "Site");
- the app.cardlink.bg web platform (the "Platform");
- the CardLink API (the "API");
- the digital cards issued through the service for Apple Wallet, Google Wallet and other supported wallets.
Together these are referred to as the "Service".
By using the Service, you accept these Terms. If you do not agree with them, please do not use the Service.
3. Definitions
- Client – a legal entity or trader that has an account on the Platform and issues cards to its own customers.
- Cardholder – an individual who receives and uses a card issued by a Client through CardLink.
- User – any person visiting the Site or using the Service.
- Card project – the configuration of the type, fields, design and features of a given card.
4. Registration and account
Using the Platform requires registration. When registering, you undertake:
- to provide true, complete and up-to-date information and to keep it that way;
- to keep your access credentials confidential;
- to notify us immediately at card@cardlink.bg if you suspect unauthorised access to your account.
You are responsible for all actions performed through your account. Registration is available only to persons over 18 years of age, acting on their own behalf or as duly authorised representatives of a Client.
5. What the Service includes
CardLink lets you create card projects, issue them into digital wallets, manage their fields, design and lifecycle, maintain a cardholder database, award and redeem bonus points, and integrate all of this with your own software through the API.
A full description of the current functionality is available on the Info and Opportunities pages. We reserve the right to develop, modify and extend the functionality of the Service.
6. Client obligations
As a Client you undertake:
- to use the Service in compliance with applicable Bulgarian and European law;
- to have a valid legal basis for processing your cardholders' personal data and to inform them properly about it;
- to ensure that the content you upload (logos, images, texts, trademarks) does not infringe third-party rights;
- not to present the cards or the Service as a means of payment, a payment instrument or a banking service, unless expressly agreed;
- to be answerable to your own cardholders for the terms of your loyalty programme – point values, discounts, promotions, deadlines and validity.
7. Prohibited use
The Service may not be used for:
- distributing malicious code, spam or unsolicited messages;
- attempts at unauthorised access, overloading or disrupting our infrastructure;
- circumventing technical limitations, API rate limits or security measures;
- decompiling, reverse engineering or reproducing parts of the Platform;
- reselling or granting third parties access to the Service without our written consent;
- issuing cards with misleading, unlawful, discriminatory or harmful content.
Where a breach is established, we may restrict or terminate access immediately.
8. Intellectual property
All rights in the Platform, the Site, the API, the source code, the design, the CardLink trademark and the documentation belong to GenCloud Ltd. and are protected by law.
The content you upload – logos, images, texts and cardholder data – remains yours. You grant us a limited, non-exclusive licence to use it solely for the purpose of providing the Service (rendering the cards, sending messages, technical support).
9. Prices and payments
Current prices are published on the Prices page. Unless otherwise agreed:
- prices are in the currency stated in the tariff and exclude VAT, unless expressly indicated otherwise;
- payment is made in advance, according to the selected plan or number of cards;
- the first 10 cards are free for testing purposes;
- we reserve the right to change prices with prior notice; changes do not affect periods already paid for.
Use of the built-in payment subsystem may be subject to additional terms of the respective payment service provider.
10. Availability and support
We make reasonable efforts to keep the Service continuously available, but we do not guarantee uninterrupted operation. Planned maintenance is possible, for which we give advance notice where practicable, as are emergency outages.
The Service also depends on external systems (Apple Wallet, Google Wallet, mobile operators, email providers), for whose operation we are not responsible.
11. Limitation of liability
The Service is provided "as is". To the maximum extent permitted by law, we are not liable for:
- lost profits, loss of customers, reputation or expected revenue;
- indirect or consequential damages;
- damages arising from a card project misconfigured by the Client;
- acts or omissions of third parties and wallet providers.
Our total liability to a given Client shall not exceed the amount paid by that Client for the Service during the 12 months preceding the event giving rise to the liability.
12. Termination
You may stop using the Service at any time by closing your account. We may terminate or restrict access in the event of a breach of these Terms, non-payment, or a legal requirement.
After termination, issued cards stop being updated. Account data is retained according to the periods set out in the Privacy policy, after which it is deleted or anonymised.
13. Changes to the Terms
We may amend these Terms. The current version is always available at this address, with the date of the last update. For material changes we notify Clients by email or through a message on the Platform. Continued use after the changes take effect constitutes acceptance of them.
14. Governing law and disputes
These Terms are governed by Bulgarian law. Disputes are settled through negotiation and, failing agreement, by the competent Bulgarian court.
Users who are individuals may also turn to the Commission for Consumer Protection (kzp.bg) or to the European Commission's online dispute resolution platform.
15. Contact
